Ultimately, unless shipowners urgently overhaul their operational models to offer shorter rotations, modern digital amenities, and a genuine commitment to seafarer well-being, the industry will continue to haemorrhage the essential human capital necessary to keep the global supply chain afloat.

  • Pilot Ladders - Do or Don't

    Providing a legally compliant pilot ladder in accordance with the latest International Maritime Organization (IMO) requirements, particularly the rigorous standards set forth in SOLAS Chapter V, Regulation 23 and recently reinforced by the 2025 adoptions of Resolutions MSC.572(110) and MSC.576(110), is absolutely critical for safeguarding the lives of maritime professionals during one of the most inherently hazardous operations at sea. The physical transfer between a small, rapidly pitching pilot boat and a massive, moving commercial vessel exposes pilots to severe risks—including fatal falls, crushing hazards, and drowning—which are drastically magnified if the ladder features defective construction, improper rigging, or non-compliant securing methods such as unauthorized deck shackles or degraded side ropes.

    Barry uses his experience of climbing 4000+ ladders during his 25 year career as a pilot to describe the requirements and highlight some of the faults that may result in a pilot not embarking the ship causing expensive delays to the ship owner.

Central to this logistical crisis is a severe marine insurance shock, where surging War Risk premiums have made navigating the Middle East financially prohibitive without state-backed intervention. This war coverage acts as a vital, highly expensive "plug-in" to standard Hull & Machinery (H&M) and Protection & Indemnity (P&I) policies, which strictly exclude acts of war but remain legally and commercially mandatory to prevent loan defaults and port entry denials (often enforced via Blue Cards). Consequently, as ships navigate these perilous waters, the complex web of maritime liability is covered by P&I Clubs and Maritime Underwriters.

  • The Rule of the Road Comes of Age

    The evolution of international collision regulations transitioned from informal 16th-century maritime customs to a rigorous legal framework with the adoption of the 1972 COLREGs, which transformed the rules into a standalone, binding treaty. This pivotal version introduced Traffic Separation Schemes (TSS) to manage congested waterways and integrated modern technology by mandating the use of radar for lookout and risk assessment. A critical legal refinement occurred with the introduction of the "not to impede" concept in Rules 9 and 10, later clarified by the 1987 Amendment (Rule 8(f)), which shifted the burden of safety onto smaller, more manoeuvrable vessels to ensure they take early action to stay clear of large ships.

    In this episode Barry tells the history of the collision regulations, from the 16th century up to modern times. He discusses the changes and advances that were necessary in order to continue to protect shipping as it evolved over centuries.

While the U.S. has countered with an unprecedented federal insurance backstop via the DFC and offers of naval escorts, shipowners remain hesitant due to "Critical" threat levels, active kinetic attacks, and widespread GPS jamming. This regional paralysis coincides with a global shift in maritime law and economics, effectively forcing the fleet into a high-cost, high-accountability era where safety, sovereignty, and sustainability are inextricably linked.

    Barry discusses the decisions facing the Master of a ship bound for the Gulf and how ultimately safety plays the biggest part in what should be done.

    Parametric rolling becomes exceptionally hazardous in shallow water because the vessel's vertical motion is constrained, and the interaction between the hull and the seabed significantly alters the ship's stability profile. When an ultra-large container ship encounters waves in shallow regions—such as the North Sea or the approaches to major ports—the "squat effect" increases its effective draft, while the restricted water flow beneath the hull can lead to more abrupt and violent stability fluctuations. As wave crests and troughs pass along the ship, the rhythmic changes in the waterplane area are amplified by the shallow-water wave dynamics, triggering rapid roll angles that can exceed 30 degrees if unchecked.

    Barry shares his personal experience of this effect, relates it to real world piloting limitations and discusses the case of the MSC Zoe from 2019. Whilst rolling in following seas in the Solent may only cause a few degrees of heel, the effect in shallow water can be catastrophic.

  • When Case Law Blurs Safety.

    The collision between the bulk carrier Polesie and the general cargo ship Verity on October 24, 2023, was caused by a failure of both bridge teams to effectively apply the 1972 COLREGs in a crossing situation. Verity, as the give-way vessel, failed to take early and substantial action to stay clear, while Polesie, the stand-on vessel, did not maintain a predictable course and speed, instead making small, incremental course adjustments to port that compounded the confusion. Contributing factors included a lack of direct bridge-to-bridge communication—exacerbated by the VTS radio configuration—and the absence of a Voyage Data Recorder on Verity, which hindered a full reconstruction of the final decision-making process.

    Barry discusses the new report and highlights areas where he feels the report did not discuss fully enough. Comparison with case law has skewed the outcome of the report and Barry discusses the dangers in this.

  • The Prestige - Accident or Crime?

    The loss of the Prestige remains one of the most contentious maritime disasters in history due to the fundamental conflict between the Bahamas Maritime Authority’s technical focus on structural failure and the Spanish authorities' emphasis on criminal negligence. While the BMA and international salvors argue that the ship was a victim of a "death march"—where the refusal of a Place of Refuge and the decision to tow the vessel into a North Atlantic storm caused its final breakup—the Spanish Supreme Court ultimately ruled that the Master and owners acted with "environmental recklessness." This judicial pivot, finalized in 2016, sought to bypass international liability caps to access a $1 billion insurance policy, a move that has resulted in a twenty-year legal stalemate between Spanish mandates and English contract law.
