Residence Permit for Special Protection and Integration: When Life in Italy Makes the Difference Good morning, I’m lawyer Fabio Loscerbo, and this is a new episode of the podcast Immigration Law. Today we talk about residence permits for special protection, or more precisely, complementary protection, and about the decisive role that social and work integration can play in the right to remain in Italy. In December 2025, the Territorial Commission for the recognition of international protection of Genoa adopted a particularly significant decision. In that case, although refugee status and subsidiary protection were denied, the Commission recognised complementary protection under Article 19 of the Italian Immigration Act, giving concrete weight to the applicant’s integration path in Italy. The assessment did not focus solely on the situation in the country of origin, but on the life built in Italy: regular employment, stable social relationships, and long-term integration into the local community. According to the Commission, forced return would have caused a disproportionate interference with the person’s private and social life, resulting in a violation of fundamental rights. This decision confirms a key point: special protection is not a residual measure and not a discretionary concession. It is an autonomous legal tool that requires an individual and concrete assessment. In this context, integration is not a reward, but a legally relevant factor that directly affects the proportionality of removal.
